BrightWay AI Terms of Service

These Terms of Service ("Terms") govern your access to and use of BrightWay AI (the "Service") operated by PestFriend LLC ("PestFriend," "we," "us"). By creating an account or using the Service, you agree to these Terms.

1) Who may use the Service

BrightWay AI is intended for families and is designed for children ages 5–12 to use under the supervision and control of a parent or legal guardian ("Parent"). The account holder must be at least 18 years old (or the age of majority where you live) and capable of entering into a binding contract.

If you are a child, you may use BrightWay AI only with Parent permission and supervision.

2) Accounts and security

  • You must provide a valid email address and create a password to register.
  • You are responsible for maintaining the confidentiality of your login credentials.
  • You are responsible for all activity that occurs under your account, including a child’s use.

3) Subscriptions, billing, and cancellation

The current release uses the Free tier and does not open new paid checkout until billing is explicitly enabled. When available, the optional Plus tier is planned at $4.99/month or $39.99/year, subject to change, with payments processed by Stripe.

  • Subscriptions renew automatically unless canceled before the renewal date.
  • You can cancel at any time from your account settings (if available) or by contacting us.
  • Fees are non-refundable except where required by law or expressly stated at purchase.

4) Acceptable use

You agree not to:

  • Use the Service for unlawful, harmful, or abusive purposes.
  • Attempt to bypass safety filters, age-mode limits, or other guardrails.
  • Interfere with or disrupt the Service (including by attempting to overload, spam, or attack the system).
  • Reverse engineer, scrape, or attempt to extract the underlying models or source code except where permitted by law.
  • Upload or provide content that infringes intellectual property rights or violates privacy rights.

5) Educational content disclaimer (AI limitations)

The Service provides educational explanations and suggested hands-on activities. Responses are generated using AI and may be inaccurate, incomplete, or inappropriate in some contexts. You understand and agree that you and your child use the Service at your own risk.

Parents should supervise activities. Use caution with any activity involving heat, sharp objects, small parts, chemicals, choking hazards, allergens, or other risks. If you are unsure, do not perform the activity.

The Service is not medical, legal, or professional advice.

AI-generated mission illustrations may be inaccurate or incomplete and are not authoritative diagrams, build specifications, or safety instructions. Follow the written materials, steps, and safety notes. BrightWay gives curated built-in visuals priority over generated art when a matching activity is available.

6) Children’s privacy

Our collection and use of personal information is described in our Privacy Policy. BrightWay AI includes data-minimization and parent controls, but it is not represented as ready for an unrestricted public child audience. Additional verifiable-parental-consent and operational review may be required before public launch.

In Solo mode, the child’s question, age band, and parent-selected project track are sent only to the AI answer provider selected by the Parent. Squad mode requires a separate Parent opt-in and sends that limited context to OpenAI, Anthropic, Moonshot AI, and xAI. BrightWay screens the resulting summaries and sends the original question plus the screened summaries to OpenAI as the captain that assembles the final mission. Squad therefore involves more third-party processing than Solo mode, and a Parent may turn it off in Parent Zone.

Optional AI mission illustrations require a separate Parent opt-in. When enabled, BrightWay may send only the already-screened mission title, materials, and steps to OpenAI for one illustration, even if another provider made the answer. BrightWay does not include the raw child question, child name, profile, account email, chat history, or provider transcript in that image request. This feature remains disabled unless the dedicated OpenAI project is explicitly confirmed for Zero Data Retention, and a Parent may revoke the permission in Parent Zone.

Quick is the ordinary lower-latency setting. Deep may use a more capable, slower, or higher-cost model and is controlled by the Parent. Model availability and behavior may change as third-party providers update their services.

A Parent must choose the Boys’ or Girls’ workshop track for a new learner profile. The track shapes examples and project wrappers while age sets difficulty; general projects may remain the same in both tracks. Questions about changing sex or gender identity are handled locally with a Parent handoff and are not sent to an AI provider.

7) Intellectual property

The Service, including its software, design, and content (excluding user-provided input), is owned by PestFriend LLC or its licensors and is protected by intellectual property laws.

You may use the Service for personal, non-commercial family use. You may not reproduce, distribute, or create derivative works from the Service except as allowed by these Terms.

8) User content

You (and/or your child) may input content such as questions or prompts ("User Content"). You retain any rights you have in User Content.

You grant PestFriend LLC a limited license to process User Content only as needed to provide and maintain the Service and enforce safety and compliance.

Visible raw chat history is stored in the family’s browser and cleared on logout in the current release. BrightWay’s application database does not keep raw question or answer logs, although selected AI providers process requests under their own terms and retention settings as described in the Privacy Policy.

Generated mission illustrations are delivered only through an authenticated BrightWay route, are retained in active storage for no more than seven days and 24 ready illustrations per account, and are deleted from active storage when a Parent revokes illustration consent. Provider image URLs and base64 image data are not placed in browser storage.

While an illustration is pending, BrightWay’s authenticated server queue temporarily holds the minimized mission title, materials, and steps for an active window of at most 15 minutes. The prompt is cleared when the job becomes ready, blocked, or failed; regular cleanup of expired records remains a deployment requirement.

9) Termination

You may stop using the Service at any time. We may suspend or terminate access to the Service if we believe you have violated these Terms, pose a safety risk, or if required by law.

10) Limitation of liability

To the maximum extent permitted by law, PestFriend LLC will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits or revenues, arising out of or related to your use of the Service.

To the maximum extent permitted by law, PestFriend LLC’s total liability for any claim arising out of or related to the Service will not exceed the amount you paid to use the Service in the 12 months before the event giving rise to the claim (or $50 if you have not paid).

11) Indemnification

You agree to indemnify and hold harmless PestFriend LLC from and against claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to your or your child’s use of the Service or violation of these Terms.

12) Changes to the Service or Terms

We may modify the Service from time to time. We may also update these Terms. If we make material changes, we will update the effective date and take reasonable steps to notify you.

13) Governing law

These Terms are governed by the laws of the State of Florida, without regard to conflict of law principles, except where federal law applies.
